Wastewater Policies
CONNECTION/DISCONNECTION
Connection to the wastewater collection and treatment system:
All residential and commercial properties are required to connect to the wastewater collection and treatment system if any property parcel line is located 200 feet or less from a main collection line.
Connection fee = $1,500
Connection to the wastewater billing system:
Connection to the wastewater billing system requires first connecting to the Domestic Water Association billing system.
Disconnection to the wastewater billing system:
Once a property is connected to the wastewater billing system a property owner may apply to disconnect from the wastewater billing system if they have already voluntarily disconnected from the Domestic Water Association billing system.
Reconnection to the wastewater billing system requires an application and payment of a reconnection fee of $800.
BILLING
Account types:
Residential
Residential Exemption/Cap—Residential account holders 65 or older or disabled with a Modified Adjusted Gross Income (MAGI) of $35,000 or less.*
- Application requires Proof of Age or Disability Status
- The MAGI amount is subject to change
Small Commercial—an average of less than 3,000 gallons of water usage per previous fiscal year
Large Commercial—an average of 3,000 gallons or more of water usage per previous fiscal year
Voluntary Disconnect—a property owner may request a voluntary suspension of wastewater service and related charges if there has been a voluntary disconnection of water service by the Jemez Springs Domestic Water Association.
Schedule:
Bills are sent out on the 15th of each month. The amount due each month is the sum of the applicable base fee, the rate for water usage recorded by the Domestic Water Association for the previous month, gross receipts tax, and any applicable late fee(s). Bills are due on or before the 15th of the following month.
Arrear accounts:
An account is considered in arrears when payment is not received on or before the due date.
Late fees, which may be amended from time to time by the Village Council, are charged when an account is in arrears.
The wastewater department may take the following steps to collect arrears.
- The wastewater department may notify the customer in writing of the outstanding balance due and give them the opportunity to pay the outstanding balance within 15 days of receiving the notification.
- The wastewater department may notify the customer that within 15 days of receiving the notification letter they are eligible to set up a payment plan to pay the balance in arrears within 120 days of notification. Additional late fees shall be waived once a plan to pay the balance in arrears is agreed upon by the wastewater department and the customer.
- If no plan is established and the outstanding balance is not paid, the wastewater department may request the Domestic Water Association to disconnect the account holder’s water. Late fees and other charges shall continue to accrue after the account holder’s water is turned off.
- The Village may file a utility lien against the property with the Sandoval County Clerk.
Changes to account status (types):
The wastewater billing system shall change the status of an account (residential, exempted, small commercial, large commercial, voluntary disconnect) when notified by the account holder and the requested change is approved by the wastewater department. The change of status will take place after approval of the requested change. Any refund or fee adjustment will be calculated from the date the wastewater department approves the status change.
Application for Exempt status: *
Application for exempt status is the responsibility of the account holder. Approval of exempt status shall be based on the age or disability status of the applicant, and the applicant’s household income, and is granted after approval of the application by the wastewater department. An applicant who is not granted an exemption may appeal the decision to the Village Council. An applicant granted exempt status shall be billed at a reduced rate determined from time to time by the Village Council. Exempt status is granted to the individual property owner or account holder, shall be reviewed at least every five years, and is non-transferable.

Frequently Asked Questions
- How do I request a wastewater credit for a water leak since the wastewater bill is based on water usage? -All credits for leaks need to be processed through the Jemez Springs Domestic Water Association. JSDWA makes the adjustments to the water bill and forwards the corrected information to the Village of Jemez Springs Office. The adjustment will be reflected the billing cycle after information is received from JSDWA.
- Why is my sewer bill not reflecting the payment I just made? -All payments made at the Village office are processed in the system within 24 hours of receipt. Sometimes payments are made after the billing system has processed the invoice for that month and the bill does not reflect the recent payment.
- When do the wastewater bills come out? -Wastewater bills are dependent upon JSDWA sending the water usage to the Village office. The goal is to mail wastewater bills out by the 15th of each month.
